The Justice Ministry’s Anti-Corruption Department (DPCA) Hotoniel Bonilla Garcia , announced the investigation of alleged extortion in Dominican Republic against British companies based in the country Biwater International, and have subpoenaed Fulgencio Marcelo Abreu Villavizar.
Fulgencio Marcelo Abreu Villavizar will be questioning on Tuesday January 18th at at 9am.
The investigation began after the chairman of the Committee for Ethics and Combating Corruption; Dr. Marino Vinicio (Vincho) Castillo formally denounced the presumed extortion. Attorney General's Office, Dr. Radhamés Jiménez Peña investigates the case too
Biwater, incorporated under the laws of England, established in Biwater House, Station Approach, Dorking, Surrey RH4 1TZ, London, UK, left the country in October 2010, even thou had won millionaires water supply contracts, because the alleged extortion and because the Dominican Government refused to pay about $5 million Dollars for works completed.
According to courts documents, Abreu Villavizar might have contributed to obtain contracts awarded by the INAPA in 2001, during the administration of the engineer Roberto Rodriguez. Back in 2001, the British hired a consortium with a Dominican group.
The British signed an agreement (2001-2002) with a person named Rondon Rijo, reserving a commission of 1% and 7% of any work in DR of a RD$204 million contract, equivalent to US$12,137,689.72 dollars
On August 2th , 2004, 12 days before Hipolito Mejia leaving the presidency, the British and Rondon Rijo signed what in DR is known as payment protocol, leaving without effect the 2002 contract (March 08, 2002) and therefore, the US$12,137,689.72 million commission.
This new agreement signed before the new Government took effect, established the payment of US$2,823,856.00. The British complied rigorously and systematically with the payment protocol, transferring the sums agreed to two U.S. banks.
Biwater constructed aqueducts in San Francisco de Macoris, La Romana and San Cristobal.
On March 30 2007, Abreu Villavizar filed a civil suit against the British companies Biwater International, Ltd, Biwater Dominicana, SA, and Calvicad Biwater Consortium (now-Sinercon Biwater), for $12 million Dollars, resurrecting the 2002 contract in order to collect US$9,313,833.72, million dollars, through their attorneys son Jotin Cury Erick Barinas and Ramon Hernandez, before the First Civil and Commercial Chamber of the National District.
The British appealed in 2008.
In 2010, the judges of Civil Court of the Supreme Court of Justice of DR, Dr. Rafael Luciano Pichardo, Dr. Eglys Margarita Esmurdoc, Dr. Margarita A. Tavares, Dr. Ana Rosa Berges Dreyfous and Dr. José E. Hernandez Machado, denied the Brithish companies the 2008 appeal against Fulgencio Marcelo Abreu Villavizar.
